But sometimes, cases surprise us all with how swiftly they’re processed. Here’s an inspiring story from one of our clients from Afghanistan. This client was granted a combined Subclass 309 Partner (Provisional) visa and Subclass 100 Permanent Partner visa—all in just four months!
Please note that this client had major security/safety concerns as they were based in Iran and held an Afghan passport.
Initial Application: Offshore Partner Visa Lodgement
Our team applied for the Subclass 309 Partner (Provisional) visa on 28 June 2024. Typically, processing times for the Subclass 309 visa range between 13 and 23 months. This is often due to a detailed assessment of the relationship’s genuineness and the applicant’s eligibility, which usually includes verifying documentation, confirming sponsorship, and meeting character and health requirements.
In this case, both the applicant and sponsor provided comprehensive documentation that met the criteria quickly. They meticulously followed our advice, ensuring that the evidence presented their relationship clearly and comprehensively. This thorough preparation was instrumental in minimising the need for additional documentation requests and other delays.
The Grant of the Provisional Visa (Subclass 309)
On 1 November 2024, only four months post-lodgement, our team received the approval for the Subclass 309 Partner (Provisional) visa. This visa allows the applicant to reside in Australia while they await a decision on their permanent Subclass 100 visa. However, the processing period for the permanent visa generally spans from 10 to 20 months after the 309 visa grant.
In this particular case, the Subclass 100 was granted simultaneously with the 309. This outcome is particularly rare and a testament to the strength of the application package and the clarity with which the case was presented. The Subclass 100 visa was granted on the same day, 1 November 2024, allowing our client indefinite stay and multiple entry rights.
Why the Fast-Tracked Processing?
Several factors contributed to the remarkable speed of this case:

- Clear and Consistent Communication: Regular and clear communication between our team, the client, and the immigration case team helped ensure that any potential issues were resolved promptly.
- Department of Home Affairs: Special team: The department has a special team that is working on partner visas from the Middle East who are prioritizing applications from Afghanistan. The team covers many countries in the region and has an extremely big case load so whilst fast-track processing is available it's really based on many factors as outlined above.
Implications for Future Applicants
This case illustrates that, although rare, expedited processing is achievable under the right circumstances. For most applicants, the standard processing times still apply, so patience is essential. However, preparing a well-documented, accurate application with no loose ends can make a significant difference.
Our advice for those applying for the Subclass 309 and 100 visas includes:
- Comprehensive Documentation: Invest time in gathering every piece of evidence to support your relationship claim. It may seem excessive, but detailed documentation can only work in your favour.
- Prepare for Delays: While some applications move swiftly, the processing times provided by the Department of Home Affairs (13-23 months for the 309 and 10-20 months for the 100) are accurate for the majority of cases. Be prepared and stay patient.
