If you're in Australia on a student visa or visitor visa and have fallen in love with an Australian citizen or permanent resident, you may be wondering: Can I apply for a partner visa while I’m here? The short answer is: Yes, you can — but there are important rules and exceptions to be aware of.
This guide explains when and how you can apply for a Partner Visa (Subclass 820/801) from within Australia, even if you're holding a temporary visa like a tourist or student visa.
What is the Subclass 820/801 Partner Visa?
The Subclass 820/801 visa is for people in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. It allows you to stay in Australia temporarily (820) and later transition to permanent residency (801).
Can I Apply for a Partner Visa While on a Student Visa?
Yes — if you’re currently holding a student visa, you can generally apply for an onshore partner visa (Subclass 820/801) as long as you meet all other requirements.
Key things to consider:
- You must be in a genuine and ongoing de facto relationship or marriage
- Your partner must sponsor your application
- You must apply before your student visa expires
- Your Bridging Visa A only activates once your student visa expires, and does not allow travel unless you apply for a Bridging Visa B.
Can I Apply for a Partner Visa While on a Visitor Visa?
Yes, you may be eligible, but additional hurdles may apply depending on your visa conditions.
✅ If You Do NOT Have a ‘No Further Stay’ Condition:
You can lodge a Subclass 820/801 application while in Australia.
You must:
- Lodge the application before your visitor visa expires
- Prove you’re in a genuine, ongoing relationship
- Understand you’ll go on a Bridging Visa A once your visitor visa ends
⚠️ If You DO Have a Condition 8503 (‘No Further Stay’):
This condition prevents you from applying for any other visa (including a partner visa) while you’re in Australia. However, you can request a waiver of the 8503 condition in compelling or compassionate circumstances — for example:
- A serious illness or injury
- A partner relationship that couldn’t be pursued outside Australia
- The birth of a child in Australia
If the waiver is granted, you may be able to proceed with the onshore application. If not, you'll need to apply offshore via the Subclass 309/100 visa.
What Evidence Do I Need to Prove My Relationship?
To be eligible for a partner visa, you’ll need to show that your relationship is:
- Genuine and continuing
- Exclusive (not married or in a de facto relationship with someone else)
- At least 12 months old (unless you are married or have registered your relationship)
You’ll be expected to provide:
- Joint financial documents (bank accounts, leases, bills)
- Photos and travel records together
- Statements from friends/family
- Proof of cohabitation (Please read this guide if your partner owns the home you live in.)
Will My Current Visa Impact My Partner's Visa Outcome?
Your student or visitor visa won’t negatively affect your partner visa outcome, as long as:
- You apply before it expires
- You don’t breach conditions (e.g., work limits on a student visa)
- You’re not precluded from applying onshore by a ‘No Further Stay’ condition
Should I Stay or Go Offshore to Apply?
It depends on your circumstances:
Stay and apply onshore if:
- You’re already in Australia
- You don’t have a ‘No Further Stay’ condition
- You want to remain with your partner during the processing
Apply offshore if:
- You’ve been refused a waiver of the 8503 condition
- You're planning to travel for an extended period
- You can’t gather the required relationship evidence from inside Australia
